Law360, New York (May 4, 2012, 1:53 PM ET) — Yahoo Inc. has informed Facebook Inc. that it may be infringing 16 patents in addition to those that Yahoo has already asserted in its lawsuit against the social media company in California federal court, Facebook said Thursday.
In a filing with the U.S. Securities and Exchange Commission, Facebook said it received a letter from Yahoo on April 23 stating that Yahoo believes 16 patents it claims to hold “may be relevant” to open-source technology it alleges is being used in Facebook’s data centers and servers.

“Yahoo has not threatened or initiated litigation with respect to matters described in this letter, but it may do so in the future,” Facebook said in the filing.

In Yahoo’s letter, obtained by Law360, Yahoo implies Facebook may be infringing U.S. Patent Numbers 6,209,003; 6,279,001; 6,314,463; 6,317,786; 6,912,534; 6,976,093;6,993,590; 7,035,943; 7,143,193; 7,243,136; 7,356,589; 7,581,006; 7,957,142; 7,430,118;7,672,128; and 8,108,347.

“Based on publicly available information, we believe that Yahoo’s proprietary server technology may be relevant to Facebook’s data centers and their servers,” the letter said.

Yahoo goes on to state that it believes at least one former Yahoo employee who had some degree of responsibility in connection with Yahoo’s data centers is now responsible for the operations of Facebook’s data centers.
